Terms of Service

You must be at least 16 years old to use Elumira. By using the Service you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian.

• You are responsible for the accuracy of the information you provide.
• You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorised access.

You agree not to:

• Use the Service to violate any applicable law or regulation.
• Attempt to reverse engineer, decompile or extract source code.
• Interfere with, disrupt, or overload the Service or its infrastructure.
• Circumvent rate limits, security controls, or usage restrictions.
• Use the Service to harass, abuse, threaten or harm anyone.
• Send prompts designed to extract other users' data or manipulate the AI into unsafe behaviour.
• Upload content that infringes another person's rights.
• Use the Service to build a competing product or to scrape data.

You are responsible for the health, wellness and personal information you choose to log. You are responsible for verifying any information from the Service with a qualified professional before making health, medical, dietary or fitness decisions.

• Elumira uses artificial intelligence (currently Google Gemini via the Lovable AI Gateway) to generate coach responses, insights and meal-scan analysis.
• AI output can be inaccurate, incomplete, biased or out of date.
• AI output is not medical, psychological, legal or financial advice.
• You should independently verify anything material and consult qualified professionals when appropriate.
• We may change, retrain, throttle, or discontinue AI features at any time.

Elumira is not a medical device. It does not diagnose, treat, cure, prevent or monitor any disease or medical condition. It does not replace consultation with a licensed healthcare provider. If you are experiencing a medical emergency, call your local emergency services immediately.

The Service, including its software, design, text, graphics, and trademarks, is owned by Elumira and its licensors. You are granted a limited, personal, non-exclusive, non-transferable licence to use the Service for its intended purpose. You retain ownership of the content you submit; by submitting content you grant us a limited licence to store and process it to provide the Service to you.

Some features may be offered as paid subscriptions or one-time purchases ("Premium"). Pricing, features and billing terms are shown at the point of purchase. Subscriptions renew automatically unless cancelled before the end of the billing period through the store where you purchased them (e.g. Google Play, Apple App Store, or our web billing partner). Except where required by law, payments are non-refundable.

You may terminate your account at any time from Settings > Privacy > Delete account. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Where reasonably possible we will give you notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELUMIRA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD 50, WHICHEVER IS GREATER. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

You agree to indemnify and hold harmless Elumira from any claims, damages or expenses arising out of your breach of these Terms or your misuse of the Service.

We may modify the Service or these Terms at any time. Material changes will be communicated in-app or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles. The courts of England and Wales have exclusive jurisdiction over any dispute, except where applicable consumer-protection law grants you the right to bring proceedings in your country of residence.
